Regular Meeting
Mayor Schwarzbach presented Karen Kibbee with a proclamation in memory of her mother, Joanne Kibbee, who served first as water clerk, then clerk and treasurer for the town from 1967 until her retirement.
Mayor Schwarzbach then called the meeting to order
Council members present: Colby Baumgarn, Jon Sheehy, Rich Jespersen and Krystyl Kulbeck
Staff present: Tim LaBuda and Wendy Kleinsasser
Public: Bob and Dianne Scalese, Karen Kibbee, Renee Hansen, Glenn Ophus, Ron Otto. Attending via Zoom: Chuck Williams and Adele Otto.
Approval of Meeting Minutes: Colby Baumgarn moved to approve all three sets of minutes. Rich Jespersen seconded. Motion passed.
Sheriff’s Report: No report
Pivot: The Council should contact 406 Agronomy for a meeting to recap how the season went. Public Works director, Tim LaBuda, is working on a piece of equipment to deal with the wheel tracks.
Public Comment: None
New Pool report: Rich Jespersen, Shaud Schwarzbach and Colby Baumgarn attended the school board meeting on the 15th. The board is having second thoughts about entering into an interlocal agreement with the town for either deeding the land for the pool or entering into a long term lease. There is another meeting scheduled for February 22. Plans B and C are being developed.
Rich reported that the fundraising is going well.
KLJ: Chuck Williams gave an update on the storm drain project. Staff from ACME will be in Big Sandy Friday, February 18th to walk the project and determine a place to keep their equipment and supplies.
Shaud reported that NCRWA voted in favor to get the pipeline done to Big Sandy.
Bear Paw Development No one from BPD was present.
New Business
Ron Otto spoke to the council regarding an issue with trucks going through town day and night with straight pipe mufflers and wanted to know if there is something that can be done. Bob Scalese suggested signage saying that compression brake muffler are required. The clerk will look into noise ordinances in other communities.
First reading of Ordinance 2021-01 as amended: This was held over until next month as the town’s attorney is working on some language in the ordinance. The first reading is scheduled for March 16th. The town’s attorney is looking into the legality of town staff and officers entering the property and remove the junk. It was also discussed what court would have jurisdiction. The town’s judge, Justice of the Peace Susan Spencer, would preside.
Old Business
Old Hotel: Rich Jespersen spoke with the current owner, who wants the town to pay the back taxes that are owing. As the town will have most of the money paid returned to it, Rich Jespersen moved that the town pay the tax liability contingent on the closing. The motion passed.
Ophus Easement: After much discussion, Rich Jespersen moved to present the easement as it is. Colby Baumgarn seconded and the motion passed, with Jon Sheehy voting nay.
Committee Reports: None
Mayor Report: The mayor reported that Field tree service will be trimming trees in the town’s parks.
Public Works: Nothing new
• The shut off list was distributed.
• The correspondence was distributed.
• Clerk: The shut off list was distributed.
Claims: Jon Sheehy moved to approve the claims. Colby Baumgarn seconded and the motion passed.
General Journal Voucher: Colby Baumgarn moved to accept JV 2022-07. Krystyl Kulbeck seconded; motion passed.

The next council meeting will be held on March 10, 2022, at 7 p.m.
