WATER RATE PUBLIC HEARING

Mayor Schwarzbach called the meeting to order.

Council members present were Ted Pursley, Jon Sheehy, Darin Ray
Staff Present: Tim LaBuda, Public Works, Larry Geyer, Public Works, Wendy Kleinsasser, clerk

Public: Luke LaLiberty, Sean Rabe, Lisa Moisey, Paul Tuss, Dennis Hale, Joanne Kibbee, Bill Kleinsasser, Terry Sandy, LeAnne Sande, Heather Pleninger, Shane Ophus, Robert Boettcher, Gene Welty, Mason Ophus

Mayor Schwarzbach opened the meeting for public comment regarding the water rate increase. The initial questions centered on whether this increase included charges for vacant lots. It was explained that this is something the council would be working on over the winter along with a rewrite of the water ordinance.

There were questions about whether the town could give senior citizens a discounted rate, which it cannot by law. The clerk handed out the spreadsheet that showed the figures that led to the increase which show clearly that the increase only addresses the new debt on the infrastructure.

Mayor Schwarzbach, along with the Luke LaLiberty and Sean Rabe of KLJ Engineering, explained the purpose of the project with special emphasis on the work being done on the fire hydrants. The future of the Rocky Boy water project was also discussed.

There were no members of the public present who expressed strong opposition to the increase.

Darin Ray made a motion to pass Resolution 2019-11. Ted Pursley seconded the motion. The motion passed on a roll call vote, with Darin Ray voting aye, Jon Sheehy voting aye and Ted Pursley voting aye. Colby Baumgarn was absent.

The hearing was then adjourned and the regular monthly council meeting went into session.

REGULAR MEETING

Mayor Schwarzbach called the meeting to order.

Council members present were Ted Pursley, Jon Sheehy, Darin Ray Staff Present: Tim LaBuda, Public Works, Larry Geyer, Public Works, Wendy Kleinsasser, clerk

Public: Luke LaLiberty, Sean Rabe, Lisa Moisey, Paul Tuss, Dennis Hale, Joanne Kibbee, Bill Kleinsasser, Terry Sandy, LeAnne Sande, Heather Pleninger, Shane Ophus, Robert Boettcher, Gene Welty, Mason Ophus

Approval of Meeting Minutes: Ted Purlsey moved to approved the minutes from the Budget Hearing and the September meeting, Darin Ray seconded. Motion passed

Sheriff’s Report: None

Public Comment: Several members present commended the mayor and council on the job they are doing.

KLJ: Luke LaLiberty gave the council an update on the pivot. A field visit with Dr. Bauder is tentatively scheduled for October 15. Any decisions to be made will come after that. Please see the attached engineering report.

New Water Project: Sean Rabe gave the council an update on the water project. Work has slowed due to the rain we have had. The contractor may request approval to work on Sundays to keep the project on its timeline. The council was given a change order to consider (Change Order #1), which will increase the project cost by $20,918.60. Jon Sheehy moved that the mayor sign the order, Darin Ray seconded and the motion passed.

Bear Paw Development: Lisa Moisey from BPD presented the council with TSEP draw request #4, the contractor’s pay request. Jon Sheehy moved to approve the draw, Ted Pursley seconded and the motion passed.

Brownfield Project: No action.

New Business

Resolution 2019-12: BaRSAA resolution to apply for grant funds from MTD. Ted Pursley moved to approve the resolution, Jon Sheehy seconded and it passed on a roll call vote, with Colby Baumgarn absent.

Bonfire: No action

Trunk or Treat: The council approved closing two blocks of Johannes Ave on Halloween for Trunk or Treat, with Darin Ray making the motion and Ted Pursley seconding.

Snow blocks on city hall roof: Public Works will install them.

Old Business

Water Ordinance: No action

Plat Approval: Jon Sheehy moved that the mayor sign off on it, Darin Ray seconded and the motion passed.

Committee Reports: None

Mayor Report: None

Public Works: The speed signs need some changes.

Clerk:
* The shut off list was distributed
* The correspondence was distributed.

Claims: Darin Ray moved to accept the claims. Jon Sheehy seconded and the motion passed.

General Journal Voucher: Darin Ray moved to approve JV 2019-03. Ted Pursley seconded, motion passed.

Any Business to be brought before the Council:

Ted Pursley moved to adjourn.
